(1) What types of cases do you handle at McMahan Law Firm? ANSWER: The eight lawyers at McMahan Law Firm, John McMahan, Brent Burks, Bart SolomonJay Kennamer, Joey Warwick, Olana Burgess, Shilpa Masih, and Fred Anthony have over 80 years of combined trial experience. We handle workers' compensation cases, car/tractor-trailer/motorcycle wrecks, Social Security disability claims, slip and falls, medical malpractice and nursing home cases. John D. McMahan is a certified civil trial specialist, one of the first in the City of Chattanooga, certified by the Tennessee Commission on Continuing Legal Education and Specialization.  Brent Burks and Bart Solomon are also certified civil trial specialists.

We have twelve paralegals including Julie Gee, Linda Reno, Perry Poole, Denise Smith, Sharon Young, Janice Poole, Susan Henson, Jeff Kovalski, Jennie Fizer, Lynda Parks and Karen Moore with experience in such diverse fields as civil litigation, healthcare and insurance.

McMahan Law Firm only handles cases on a contingency fee basis. In workers' compensation, by law, the firm is limited to a legal fee of 20%, and by law, we are limited to a 33 1/3% contingency fee in medical malpractice cases. The typical car wreck case is usually handled on a 33 1/3% contingency fee basis, whereas slip and falls and other premise liability cases are usually handled on a 40% contingency fee contract.

(2) When I call, most of the time I talk to your legal assistants, why is that? ANSWER: The attorneys in our firm have to spend many hours and days outside of the office questioning witnesses or trying the various cases we have at our law firm. We are a trial law firm. Further, our legal assistants are always at the office, and are thus available at all times to take your important calls. Our legal assistants have developed specialties over the years, and thus they are appropriately trained to answer your questions, handle your problems, or deal with insurance adjusters, risk managers or the doctors. Further, we have a state-of-the-art computer system, and each legal assistant inputs all conversations with all clients into the computer system, and I can review the substance of those conversations at any time. If it is necessary for me to return your phone call, the legal assistant will bring the information to me; I will review the computer information and your file, and then return your phone call. I have the utmost confidence and faith in my legal assistants, and they are very concerned about your case and the resolution of your case.

(3) Why does your firm refer me to voice mail when I call? ANSWER: Oftentimes when you call, the legal assistant assigned to your case will be on the telephone or in conference. We have a voice mail system that allows our clients to leave detailed messages about their circumstances. We regularly check our voice mail messages, and it is the policy of McMahan Law Firm to return all of our phone calls within 48 hours. Therefore, if you will leave a voice mail message describing your difficulties or issues, we can then prepare a response, review your file, and be ready to address that issue when we return the phone call after we get off the telephone or after we are out of our conference. Your case is important to us, and yet, we cannot handle a volume of cases without our voice mail system. Remember, when you call, that takes us away from our conversations or work on your file. We need to concentrate on our communications with the insurance company, their attorneys and the doctors, since that will hopefully result in a positive resolution of your case.
